District Mineral Foundation Trust (DMF) is a trust set up as a non-profit body, in those districts like SPSR Nellore that are affected by the mining works. This has been set up to work for the interest and benefit of persons and areas affected by mining related operations. It is funded through the royalty contributions from mining companies. It was mandated through the Mines and Minerals (Development & Regulation) Amended Act (MMDRA) 2015. In this regard, DMF Trust SPSR Nellore was registered 01.04.2016 and is continuing to work for the development needs of people affected by various mining operations.

Further, DMFT Nellore is implementation Pradhan Mantri Khanija Kshetra Kalyan Yojana (PMKKKY). The overall objective of PMKKKY scheme is to implement various developmental and welfare projects / programs in mining affected areas. In this manner, DMFT Nellore would attempt to Minimize adverse impacts of mining on directly and indirectly affected people of the district. Thus, is will work to ensure long-term sustainable livelihood for the affected people in mining areas.

For the Financial Year 2021-22, the focus of the DMF Nellore has been on sectors such as skill development, public health, COVID-19 pandemic, education, improving key physical and water resources infrastructure and women and child development. The focus has been on essential projects which are critical for provision of basic amenities followed by initiatives which directly or indirectly impact public health and livelihood enhancement. The total funds approved for the FY 2021-22 amount to INR 10.63 Crs while DMF Funds expenditure amount to Rs.4.60 Crs.

DMFT Nellore has been pursuing these objectives in letter as well as spirit by working as per the needs of people affected by Mining. A bottom – up approach has been adopted and Panchayati representatives have come forward with the proposal passed by Gram Sabhas in Governing Council Meetings. In coming years, through need analysis and deeper participate planning exercise, DMFT Nellore and the entire district administration will strive to mitigate the impact of mining operations on both directly and indirectly affected mandals of SPSR Nellore district.

Preamble

            The Government of India vide Act No. 10 of 2015 dated 27.03.2015 (w.e.f. 12.01.2015), made amendment to the Section-9 of MM (D&R) Act, 1957 by inserting Section-9B (1) to (6). As per Section 9-B(1), in any district affected by mining related operations the State Government shall, by notification, establish a trust, as a non-profit body, to be called the DISTRICT MINERAL FOUNDATION. Hence, the Government of Andhra Pradesh, under the powers conferred under Sub-Section (1) of Section-9(B) of M and M (D&R) Amendment Act, 2015 vide G.O.Ms.No.42, Industries & Commerce (M-II) Department, dated 27.06.2015 issued Notification for establishments of DMF’s in each of (13) Districts of Andhra Pradesh State, being mineral bearing District.

            Subsequently, Ministry of Mines, the Government of India vide notification G.S.R. No. 715 (E) dated 17.09.2015, makes the Mines and Minerals (contribution to District Mineral Foundation) Rules, 2015 specifying the amount to be paid by holder of a ML or a PL-cum-Mining Lease, in addition to the Royalty, to the DMF of the district established by the concerned State Government by notification, in which the mining operations are carried on. As per the Rule-2 of this rules the rate of DMF contribution is 10% of Royalty in respect of Mining Leases or PL cum ML granted on or after 12.01.2015, 30% in respect of MLs granted before 12.01.2015 and as per the Notification GSR No. 837 (E) dated 31.08.2016 substituted Rule-3 the amount calculated at the rate specified in Rule-2 shall be paid w.e.f 12.01.2015.

            The Government vide G.O.Ms.No.36, Industries & Commerce (M-II) Department, dated 14.03.2016 made the District Mineral Foundation Trust Rules, 2016 duly forming the modalities, fixation rate of DMF etc. After issuing these rules, the Deed of Mineral Foundation Trust Deed in Form-A (ANNEXURE-I) executed between the State Government of A.P, represented by the Secretary, Department of Mines, Government of A.P and the members of the Governing council.
