JUVENILE WELFARE
a) DEPARTMENT PROFILE :
The Department of Juvenile Welfare was created by vertical bifurcationfrom the Prisons Department in the year 1990 for effective implementation of Juvenile Justice Act and to provide care, protection, treatment, development and rehabilitation of ‘Children in need of care & protection’ (orphans, victims of exploitations, abuse, run-aways etc.) and ‘Children in conflict with law (children who have been alleged to have committed offences) up to the age of 18 years. The subject of Probation Services under the “Probation of offenders Act, 1958” was transferred to the Dept in1995.
I. PROBATION SERVICES (Established under Probation of Offenders Act 1958):

1.Preliminary Enquiries:- The Probation Officer conducts Preliminary Enquiries into the Character, antecedents and home surroundings, Criminal record of offenders and submits confidential reports to the concerned Courts. The Probation Officer is not empowered to conduct any enquiry sue motto, only on receipt of the Preliminary Enquiry orders from the Courts, he has to conduct the enquiries. | |||
2. Supervision Work:- The Probation Officer Supervises the behavior of the persons placed under his/her Supervision by the Courts and during periodical visits tries to modify the behavior of the offender through counseling. Monthly progress reports of Probationers are sent to the concerned Courts. | |||
3. Rehabilitation:-The Probation Officer assist the first-Offenders for their rehabilitation in Society by mobilizing community resources and also through District Probation Advisory Committee of the District. | |||
II. Under the Juvenile Justice (Care and Protection of Children) Act, 2015:- | |||
1. Social Investigation Reports:- The Probation Officer conducts enquiries on Children’s and submit Social Investigation Reports to the Hon’ble Juvenile Justice Boards (for children in conflict with law) and suggest the mode of the treatment to be followed for rehabilitation of children. | |||
2. Supervision of Children’s:- The Probation Officers also supervise the Children in conflict with law. Whenever such children are placed under their supervision, they are paying visits regularly and counsel the parents and also submits periodical reports to the Hon’ble Juvenile Justice Boards. They also Endeavour to provide possible help for their economic rehabilitation. | |||
3. Registration of Child Care Institutions):TheDistrict Probation Officer, whois working in the head quarter of the district is also designatedas District Level convener intheprocessof registration of “Child Care Institutions” run by Government and NGO under Juvenile Justice Act2015 through District Level Approval Committee headed by the Collector & District Magistrate. | |||
III. JAIL ENQUIRIES :- | |||
In addition to their duties and responsibilities under the Probation of Offenders Act, 1958 and the Juvenile Justice ( Care and Protection of Children) Act 2015 the Probation Officers are conducting the Jail enquiries. | |||
1. Parole Enquiries:- The District Probation Officers conduct Parole Enquiries as per the requisitions of the Prisoner received through the Superintends of concerned Central Prisons and submit their reports to the concerned Superintendents. | |||
2. Premature Release Enquiries:- The District Probation Officers conducts Premature Release Enquiries for the discharge of the Prisoners (lifers) from Central Prisons. | |||
3. Supervision & Rehabilitation of Ex-Convicts:- The District Probation Officers supervise the Ex-Convicts (prematurely released from Central Prisons) quarterly once and try to extend all possible help for their socio-economic rehabilitation. | |||

II. Registration of Child Care Institutions:
All child care institutions as defined in Section 2(21) of JJ Act 2015’, whether run by a State Government or by voluntary or non-governmental organizations, which are meant, either wholly or partially, for housing children in need of care and protection or children in conflict with law, shall, be registered under section 41 of Juvenile Justice (Care and Protection of Children) Act 2015.
The District Probation Officer, who is working in the head quarter of the district is also designated as “Convener” in the process of registration of “Child Care Institutions” run by Government and NGO under Juvenile Justice Act 2015 through District Level Approval Committee headed by the Hon’ble Collector & District Magistrate.
At present 29 Child Care Institutions are functioning by the both Government and NGOs in the District for reception & rehabilitation of ‘children in need of care & protection’.
III. Juvenile Justice Board, SPSR Nellore District:
The JJB consists of a Judicial Magistrate of First Class (hereinafter referred to as Principal Magistrate) and two social workers forming a Bench and every such Bench shall have the powers conferred by the Code of Criminal Procedure, 1973 (2 of 1974) on a Metropolitan Magistrate or, as the case may be, a Judicial Magistrate of First Class for exercising the powers and discharging its functions relating to “children in conflict with law” under this Act.
IV. Child Welfare Committee, SPSR Nellore District:
The Child Welfare Committee consists of (5) members, including (1) Chairperson and (4) Membersformed as a benchfor exercising the powers and to discharge the duties in relation to “children in need of care and protection” under this Act.
